Bank accounts locked and cash withdrawn after elderly gave power to law firm partner by Sue MitchellElderly and vulnerable people in south-east England have told the BBC how they lost control of their money and property after dealing with a law firm based in Essex. They described how they were persuaded - and sometimes felt under pressure - to grant lasting power of attorney (LPA) to a man called Ron Hiller, a partner in the firm.LPA is a legal agreement in which someone appoints an "attorney" to make decisions on their behalf, either for finance or health and welfare.Attorneys are supposed to act in their clients' best interests. But we investigated 30 cases involving Mr Hiller and his firm, Craybeck Law, and found a disturbing pattern of events:People found they had no access to their bank accounts and no idea how much Mr Hiller was charging for being their attorneyLarge amounts of cash were withdrawn without a reasonable explanationProperties were sold for what owners and[…]

by Chelsea DonaldsonI met Frank during the height of the COVID-19 lockdown, in early 2020. We could not meet in person, and so I had to perform a legal intake with him over the phone on the floor of my bathroom – the only room in my studio apartment that had a door so I could maintain privacy.  The phone call was brief and confusing, and the only thing he could tell me was that the military harmed him, and that he could remember his social security number.  He wanted me to represent him in a disability claim for service-connected compensation through the Department of Veterans Affairs. Frank had schizophrenia. His type was severe. He suffered from hallucinations and delusions that were so all-encompassing that I sometimes wasn’t entirely sure whether or not he knew he was talking to me or to the voices in his head. He struggled with[…]

Burlington County nursing home with nation’s biggest fine for a safety violation this year faces Medicare and Medicaid crackdown Story by Harold BrubakerSterling Manor Nursing Center, a Burlington County nursing home, received the nation’s biggest fine for patient safety violations this year and is now facing a federal and state crackdown. Regulators have threatened to terminate its participation in Medicare and Medicaid, the government insurance programs that pay for most nursing home care. Federal regulators fined Sterling Manor $738,590 in connection with a January complaint inspection that uncovered multiple drug overdoses by residents. Separately, in July, Sterling Manor was fined an additional $266,450, but details on why were not immediately available. The two fines gave Sterling Manor the highest total for financial penalties nationwide out of more than 2,300 nursing homes with fines from January through Oct. 2, an Inquirer review of federal records found. The facility’s history of “serious quality issues” is reflected in a warning icon posted on a Medicare website that rates nursing homes on quality[…]

Casey Chairs Final Aging Committee Hearing on Disability Rights U.S. Senator Bob Casey (D-PA), Chairman of the U.S. Senate Special Committee on Aging, held an Aging Committee hearing entitled “Empowering People with Disabilities to Live, Work, Learn, and Thrive.” At the hearing, Chairman Casey highlighted his long record as a champion for people with disabilities, and laid out his vision for how Congress must continue to work to empower them. The hearing was Casey’s last as Chairman of the Aging Committee. “From the beginning of my time in the Senate, I heard a constant refrain from disability advocates that their needs were not being met—they faced barriers to save for their future, they were being paid well below a living wage, and they could not afford or access the care they needed,” said Chairman Casey. “Those refrains, including from some of the people we heard from at today’s hearing, are what inspired me to make people with disabilities a focus of my Senate[…]

Conahan and fellow Judge Mark Ciavarella, both of Luzerne County, Pennsylvania, were convicted in connection with a scheme that sent thousands of juveniles to two private detention centers in exchange for millions of dollars in kickbacks. Nexstar’s WBRE spoke with Amanda Lorah, a victim of the Kids for Cash scheme. She called the clemency for Conahan simply wrong and an injustice.“It’s a big slap in the face for us once again,” Lorah said after hearing that Biden had commuted the Conahan’s sentence. “We had no time to get any time taken away from us. Report says lack of legal representation in adult guardianship cases is a problem, some disagree By Patty WightIt's a weekday morning, and Charlee Beaulieu slides into the driver's seat of a car and buckles in.She needs to get to her job as a cashier at a grocery store in Ellsworth. She's learning to drive, so her best friend's mom, Lisa Cloutier, offers gentle guidance from the passenger's seat."Remember, step on the brake and then the gas," Cloutier says.Driving, having a job: these are milestones that some may take for granted. But not Beaulieu. She's 25 and has a developmental disability. And until recently, she was under the guardianship of her adoptive mother. "She was afraid that if I went out on my own, I would be homeless," Beaulieu says. "She was really concerned about, like, predators and stuff."The state's guardianship system is intended to protect vulnerable Mainers from potential danger and abuse. But a recent study found that most people in Maine who are considered[…]

Nurse faces sentencing for wanton neglect in death of nursing home resident By: Clark KauffmanAn Iowa nurse who was criminally charged in the death of a nursing home resident is facing up to two years in prison after entering a plea in the case. In March, Pocahontas County prosecutors charged Becky Sue Manning, 70, of Lake View, with felony wanton neglect of a health care facility resident, an aggravated misdemeanor. Court records indicate Manning recently entered an Alford plea of guilty to the charge in which she didn’t admit to the underlying allegations, but acknowledged there is sufficient evidence to prove wanton neglect should the case go to trial. Sentencing is scheduled for Jan. 13, 2025. The charge carries a minimum penalty of an $855 fine and a maximum penalty of two years in prison plus $8,540 in fines. Poppe’s sister, Jill, isn’t elderly. She doesn’t have Alzheimer’s or dementia. She’s 50 and in a nursing home, with Medicaid picking up the expenses, because so many people in the state with mental disabilities or illness are being warehoused in nursing homes. They are in facilities like the Normandy Nursing Center, where Jill lives, because of a “series of systematic failures of the state” of Missouri. That’s what a Department of Justice report determined this past summer, when the federal government notified Missouri that it was likely in violation of the Americans with Disabilities Act by failing to provide mentally ill people with access to services in their communities.“Specifically, the State fails to provide sufficient community-based services,[…]

Such dramatic evidence of alleged eldercare abuse is rare, one national expert told New Mexico In Depth on Wednesday, adding that abuse often goes unreported and unaddressed, in part because there are gaps in oversight of such facilities. The four defendants are Salomon Sanchez, 20, a worker at Community Options, Inc.’s facility in Santa Fe; Lee Carrizales, 64, an employee at Pacifica Senior Living in Santa Fe; Edwards D.
